Most times you will find that one conversation will go a long way and the issues will be resolved. This was a tough case because there was no surveil This was a tough case because there was no surveillance video and we could not prove who threw the bottle (or corroborate that a bottle in fact hit our client). But through taking some key depositions we were able to show the insurance company involved that they would be taking a big risk going to trial. Often times dental injuries are severely undervalued so a lot of hard work was done getting this settlement into the six figures. 𝐂𝐨𝐧𝐬𝐭𝐫𝐮𝐜𝐭𝐢𝐨𝐧 𝐬𝐢𝐭𝐞 𝐚𝐜𝐜𝐢𝐝𝐞𝐧𝐭𝐬 𝐚𝐫𝐞 𝐬𝐡𝐨𝐜𝐤𝐢𝐧𝐠𝐥𝐲 𝐜𝐨𝐦𝐦𝐨𝐧, especially here in New York where construction activity is so common you don’t even notice it.     Some of the worst injuries we see are from construction site accidents.     Because of this, New York has strong Labor Laws in place in attempt to provide for safer construction sites and rights of the construction workers to bring lawsuits for injuries sustained on the job.     As I share in this video, generally speaking, some of the key elements of these laws are:    1) The requirement that construction site managers provide adequate protection from hazards for all construction workers    2) The strict regulation of scaffolds and ladders that protect workers from gravity-related injuries such as the worker falling from them… or from materials falling from above and striking the worker    3) Providing 𝐀𝐃𝐃𝐄𝐃 𝐩𝐫𝐨𝐭𝐞𝐜𝐭𝐢𝐨𝐧 at sites requiring excavation, demolition, or overall construction work.     Property owners and contractors working on a site have a responsibility to maintain the site in a safe condition. Yet, we see common construction site accidents routinely, such as:    Falls and falling objects, scaffolding collapses, and equipment and machinery malfunctions.    If you are the victim of a construction site accident, make sure to seek medical attention immediately an then consult with an attorney that you feel you can trust so they can immediately start an investigation.     The statute of limitations on a construction site accident case in NY is 3 years.     Lastly, here is my plea to all construction workers - 𝐃𝐎 𝐍𝐎𝐓 𝐒𝐈𝐌𝐏𝐋𝐘 𝐑𝐄𝐋𝐘 𝐨𝐧 𝐲𝐨𝐮𝐫 𝐞𝐦𝐩𝐥𝐨𝐲𝐞𝐫 or a contractor giving you proper safety equipment or safe directives. How are injury lawsuits for children handled?    These cases are hard to even think about. It pains us to hear about people who disqualify TH It pains us to hear about people who disqualify THEMSELVES from pursuing a claim or lawsuit because they think since they were partially at fault they would lose.      In most states, this is WRONG!      Many incidents are not so cut and dry as to 1 party being 100% at fault. Juries often find both parties at fault. And that is ok.      The law of most states provides for some sort of determination as to comparative fault meaning you can still recover even if you’re partially at fault.      In NY we have what’s called a PURE comparative fault rule. So, if you are partially responsible than the amount you can recover for your damages will simply be lowered by the percentage of your fault, no matter how great that percentage is.      If you are injured in any type of incident just call a lawyer you can trust. A trial term we hear a lot is BURDEN OF PROOF.  A trial term we hear a lot is BURDEN OF PROOF.    Perhaps no concept is more critical to justice being served at a trial.    So, it is critical for all potential jurors to understand it.    The burden of proof refers to which party – either the defendant or the plaintiff – has the responsibility of showing evidence to prove their claim.    The STANDARD of the burden of proof is what we often hear about because its drastically different in a criminal case as opposed to a civil case, like a personal injury matter.    The criminal case standard – beyond a reasonable doubt – is a very high burden and hard to achieve.    In a civil case, using NY as an example, the standard - a preponderance of the evidence - is simply that it is slightly more likely than not. It can be as slight of an edge as 50.1% versus 49.9%.    That is all it takes for a plaintiff to prove her case successfully.    And if the defendant wants to pass blame to the plaintiff, its critical to know that the defendant must PROVE with the burden of proof that the plaintiff actually did something unreasonable or wrong. The defendant cannot just assert “the plaintiff could have turned her wheel before defendant crossed over the double yellow lines and struck her.”    So, when you are on a jury in a civil case, please remember that you only need to hold the plaintiff to the much lesser civil burden of proof standard – that is more likely than not – than the extremely high burden of a criminal trial.    AND please make sure your fellow jurors do the same.
