Construction Site Accidents
Unfortunately, construction site accidents are far too common. Even more devastating is that a majority of these accidents, and the injuries they cause were entirely preventable. In New York, there are strong Labor Laws in place to protect construction site workers and allow for them to bring a lawsuit. Some of the key elements of these laws are: 1) the requirement that construction site managers provide adequate protection from hazards for all construction workers; 2) the strict regulation of scaffolds and ladders that protect workers from gravity-related injuries such as the worker falling from them… or from materials falling from above and striking the worker; and 3) providing ADDED protection at sites requiring excavation, demolition, or overall construction wor ....
Injury lawsuits for children
If your child was injured in an incident then yes of course you, as the parent or legal guardian, can bring a lawsuit on his or her behalf. In a typical accident you’ll most likely act as if the child was an adult and file suit in due course. But, its critical to know that you do not have to. For a child the normal statute of limitations to file a suit (3yrs for most injury cases in NY) does not apply. The SOL is tolled or extended for children. In New York, for most personal injury cases, a minor may file a lawsuit up to three years after their 18th birthday. There are some exceptions. For example, if the injury results from medical malpractice, the statute of limitations can be extended but only up to ten years. Now, after the lawsuit is resolved with a settlement ....

The New York Adult Survivors Act
The Governor of New York has recently signed into law The Adult Survivors Act which, like the Child Victims act of 2019 will now allow adult survivors of sexual assault and abuse to file civil suits against their abusers and the institutions that protected them. The critical part about this Act is that it will create a one-year look back window for survivors to file civil suits for abuse that occurred after the age 18, regardless of when the original statute of limitations on their case expired. Meaning no matter what, if you were over 18 when the abuse happened, you can file a lawsuit for 1 year. Obviously, these are very serious and deeply personal situations. Nobody should take them lightly. But understand that this 1 year period will go quickly, so if you were the ....

It’s a dangerous world out there for children
Taking a child to a baseball game is a time-honored American tradition. For generations, parents have been taking their kids to the ballgame to enjoy the site and smells of our national pastime. However, as much fun as a baseball game can be for fans and their children, there are also significant dangers. In addition to the potential for unruly fans and sometimes dangerous commutes, the game itself can pose significant dangers in the form of flying baseballs. If kids aren’t careful, a foul ball can cause serious, sometimes fatal, accidents. A Child Was Hit by a Foul Ball at a Yankees Game A couple weeks ago, a young girl was struck by a foul ball in Yankee Stadium, according to a report in Sports Illustrated. The ball was a line drive hit by Yankee’s third-baseman ....
Drone Milestone Raises Questions
Our neighbor to the north was home to a drone-related milestone last week, as a drone collided with a commercial aircraft in Canadian airspace. This is the first time such an incident has occurred in North America. Canadian Transport Minister Marc Garneau was relieved that the plane only sustained minor damage, but said the incident never should have happened. “That drone should not have been there.” According to the New York Post, despite reports by pilots claiming that drones have crashed into their planes, the FAA has not verified any such accidents. It’s obvious why such accidents are of concern to the FAA and other public safety entities, but what does the increasing presence of drones in the sky mean for the residents of New York City? A recent loc ....
New York’s car seat law is changing
Is your vehicle ready? According to AAA, a one-year-old child is injured in a car crash about once every day in New York state. With precious young lives on the line, it is critical that people do everything possible to prevent these injuries and keep small passengers safe. Some of these injuries occur because children are not properly secured in child safety seats. Having the right car seat is essential for young passengers, but the state has not always provided clear guidance to parents. Many parents and caretakers may not know what safety equipment children of different ages need. Clear requirements for children under two To address that, Governor Andrew Cuomo recently signed a bill into law that will clear up car seat requirements for the parents of young children ....
